2. Information and data collected automatically by the Site – Cookies

a) Information collected automatically

Similarly to all web-sites, our Site uses log files in which information is automatically collected and stored during the Users’ visits. The IT systems and software procedure that make the Site work automatically acquire some information during usage, whose transmission is part of the internet communication protocols.

The collected information is the following:

• internet protocol address (IP) or the dominion name of the device you are using;
• type of browser and parameters used to create a connection to the Site;
• the addresses annotated in URI (Uniform Resource Identifier) of the required resources or the method used for submitting the request to the server
• name of the internet service provider (ISP);
• date and time of the visit;
• web-page of provenance (referral) and destination after exit by the User;
• number of clicks, where applicable.
• the dimension of the file obtained as a reply
• the numerical code indicating the state of the reply by the server (completed, error, etc.);
• further parameters relating to the operating system and the IT environment of your device.

This information is processed automatically and collected exclusively in an aggregated way in order to monitor the correct functioning of the Site.

We need your data in order to allow you, by means of using the Site, to navigate it and to use all the functions included inside the Site.

The data provided by you will be processed predominantly with information systems under the authority of the Controller, by third parties specifically commissioned, authorized and instructed to the processing as per section 29 of the Data Protection Regulation and section 2-quaterdecies of the Privacy Law. We inform you that appropriate security measures, also as per sections 5 and 32 of the Privacy Law, have been adopted to prevent loss of data, illicit or inappropriate uses and unauthorized access.

Please be aware that for the scopes listed in paragraph 3, collection of your personal data happens also automatically and is necessary to navigate the Site and to use all the functions included there.

Please remember that in any circumstance and at any time, you may require the cancellation of your data to the Controller by means of a simple communication to be sent – without further formalities – to the addresses listed at paragraph 1.

With reference to the items (i) and (iii), and of preceding paragraph 3, the juridical base of the processing is the execution of the services provided by means of the Site, as per section 6, paragraph 1, letter b) of the Data Protection Regulation; instead, with reference to the scope listed at item (ii) of preceding paragraph 3, the juridical base for processing is the compliance – on behalf of Fapay – with legal obligations, as per section 6, paragraph 1, letter c) of the Data Protection Regulation.

5. To whom and in which context may we transmit your data

Your data may be communicated, in Italy, inside or outside the European Union, in full compliance with the Data Protection Regulation and the Privacy Law, to the following entities:

• to public authorities, where this is mandated by law or required by the authorities;
• to the external structures/companies the Controller uses for the execution of activities related, instrumental or consequent to the use of the Site and any other provision of services included into the Site, if any;
• to external consultants, if not nominated Data Processors.

6. Users’ rights

At any time, you may exercise your rights as per section 15 of the Data Protection Regulation, for access, rectification, transformation, blocking, cancelling and limitation of the processing, with the procedures established by section 12 of the Data Protection Regulation and with the limits as defined by section art. 2-undecies of the Privacy Law.

7. Duration of the processing

Except for legal obligations, the Users’ personal data will be conserved for a period of time which does not exceed the time needed for fulfilling the scopes for which they are processed (so-called “principle of limitation to conservation” as per section 5 del Data Protection Regulation). Periodically, a verification process is performed to verify the obsolescence of the stored data in relationship to the scopes for which they were collected.

Notwithstanding the above, Fapay may conserve some of your personal data exclusively for the scope of defending or safeguarding its rights, or in those cases as defined by law or by order of a judicial or government authority.

8. Security measures

By means of the Site, your personal data are processed in respect of applicable law and adopting appropriate security measures, in compliance with the regulations in force, also as per sections 5 and 32 of the Data Protection Regulation, aimed at preventing unauthorized access, theft, publication, modification and unauthorized destruction of your data.

9. Modifications to the Data Protection Information Sheet

The current Information Sheet is subject to modifications by the Controller; Fapay will communicate any modifications on the Site, with a prenotice period of at least 15 days with respect to the date in which the new Information Sheet will apply.

Tali informazioni sono trattate in forma automatizzata e raccolte esclusivamente in forma aggregata al fine di verificare il corretto funzionamento del Sito.

3. I dati personali che ci fornisci utilizzando il Sito: a che fine li trattiamo

I Tuoi dati ci servono per consentirTi, attraverso l’utilizzo del Sito, di navigarvi ed usufruire di tutte le funzioni contenute all’interno del medesimo.

In ogni caso, Fapav si impegna a utilizzare i Tuoi dati personali unicamente nei modi, termini e per le finalità specificate di seguito:

4. Natura del conferimento dei dati e base giuridica del trattamento

Sappi che per le finalità di cui al precedente paragrafo 3, il conferimento dei Tuoi dati personali avviene anche in automatico ed è necessario per poter effettuare la navigazione del Sito o per usufruire di tutte le funzioni ivi contenute.

RicordaTi che, in ogni caso ed in qualsiasi momento, potrai richiedere al Titolare la cancellazione dei Tuoi dati tramite una semplice comunicazione da inviarsi, senza particolari formalità, ai recapiti di cui al precedente paragrafo 1.

Con riferimento alle finalità di cui ai punti (i) e (iii) del precedente paragrafo 3, la base giuridica del trattamento è l’esecuzione dei servizi forniti attraverso il Sito e da Te richiesti, ai sensi dell’art. 6, comma 1, lett. b) del Regolamento Privacy. Invece, in merito alla finalità di cui al punto (ii) del precedente paragrafo 3, la base giuridica è l’adempimento – da parte di Fapav – di obblighi legali, ai sensi dell’art. 6, comma 1, lett. c) del Regolamento Privacy.

5. A chi e in che ambito possiamo trasmettere i tuoi dati

I Tuoi dati potranno essere comunicati, in Italia, all’interno o all’esterno della UE, nel pieno rispetto di quanto previsto dal Regolamento Privacy e dal Codice Privacy, ai seguenti soggetti:

(i) ad enti e/o autorità pubbliche, ove ciò sia imposto dalla legge o su loro richiesta;

(ii) alle strutture, ai soggetti ed alle società esterne di cui il Titolare si avvale per lo svolgimento di attività connesse, strumentali o conseguenti all’utilizzo del Sito e all’eventuale fornitura dei servizi ivi richiesti;

(iii) ai consulenti esterni, se non designati per iscritto Responsabili del trattamento.

6. I tuoi diritti

In qualsiasi momento potrai esercitare i diritti di cui agli artt. 15 e segg. del Regolamento Privacy, per l’accesso, la rettifica, la trasformazione, il blocco, la cancellazione, la limitazione del trattamento, nelle modalità stabilite dall’art. 12 del Regolamento Privacy e con i limiti di cui all’art. 2-undecies del Codice Privacy.

7. Durata del Trattamento

Fatti salvi gli obblighi di legge, i Tuoi dati personali verranno conservati per un arco di tempo non superiore al conseguimento delle finalità per le quali sono trattati (c.d. “principio di limitazione della conservazione” di cui all’art.5 del Regolamento Privacy). La verifica sulla obsolescenza dei dati conservati in relazione alle finalità per cui sono stati raccolti viene effettuata periodicamente.

Nonostante quanto precede, Fapav potrà conservare taluni Tuoi dati personali esclusivamente per difendere o far valere un proprio diritto ovvero nei casi previsti dalla legge o per effetto dell’ordine di un’autorità giudiziale o amministrativa.

8. Misure di sicurezza

Attraverso il Sito, i Tuoi dati saranno trattati nel rispetto della legge applicabile ed utilizzando adeguate misure di sicurezza, nel rispetto della normativa in vigore anche ai sensi degli artt. 5 e 32 del Regolamento Privacy, volte ad impedire accessi non autorizzati, furto, divulgazione, modifica o distruzione non autorizzata dei Tuoi dati.

9. Modifiche all’Informativa privacy

La presente informativa è soggetta a modifiche da parte del Titolare del trattamento; Fapav Le comunicherà sul Sito stesso le modifiche, con un preavviso di almeno 15 giorni rispetto alla data in cui si applicherà la nuova informativa.
